TriplePoint Design Build Completes Required EPA Renovation, Repair & Painting Program (RRP) Certification

Beginning April 22, 2010 Federal Law will require that contractors performing renovation, repair and painting projects that disturb lead-based paint in homes, child care facilities, and schools built before 1978 to be certified and follow specific work practices to prevent lead contamination.

Any contractor, firm, or person working on or renovating “Target Housing” (generally any residential home or child care facility), built before 1978 where more than six square feet of a room or more than twenty square feet of exterior wall is to be disturbed, repaired, altered or replaced. Windows and doors are subject to the lead RRP rules regardless of their size.

The certified contractor will have to contain the work area from dust and debris and install warning signs, and will also be required to install heavy-duty plastic and tape to cover the floors and any furniture that cannot be moved. The certified contractor will have to prevent dust or debris from getting outside the work area by sealing off doors, and heating and cooling system vents. The certified contractor will be required to employ all techniques necessary to reduce the amount of contaminated dust.

Almost all contracting trades and their employees will be affected by this EPA rule – plumbers, electricians, painters, contractors, cabinet installers, drywall, painters, etc. The rule covers anyone – not just licensed contractors. Maintenance personnel, managers, etc., all must follow the new regulations.

The EPA is serious about this rule. Fines are $32,500 for each violation with an additional $25,000 per violation, or imprisonment, or both for willful or knowingly violating the law.
